These Terms and Conditions apply to all trips and travel services arranged for or provided to you ("you," which term shall be deemed to refer to you and to any person in your party), by Your Travel Nation ("we" or "us"). Please read them carefully. These Terms and Conditions, the Invoice(s), and the Itinerary (collectively, the "Documents") constitute the contractual relationship between you and us, which relationship commences when we receive your deposit or any payment from you.
1. Reservations and Payments
Reservations will be confirmed, based on availability, upon written notice from us to you regarding the number of travelers in your party and upon your payment of a deposit. The deposit may be paid by major credit card or wire transfer to "Your Travel Nation." The balance is due as set forth in the Invoice(s).
2. Cancellations and Refunds
Cancellations by You: You must notify us in writing (by mail or email) of any cancellation. Cancellations are effective on the day received by us. Refunds will be issued less a cancellation fee based on when we receive your notice:
Notice Received by Us | Amount Refunded to You |
|---|---|
30 days or less before departure | No refund |
31–89 days before departure | 50% of total travel sum |
90 days or more before departure | 85% of total travel sum |
All refunds are also subject to the refund policies of hotels, airlines, and other vendors, which may further reduce the amount refunded. We strongly recommend securing travel insurance that covers lost deposits and cancellation fees.
Cancellations by Us: If we cancel the trip prior to departure, you will receive a full refund of amounts paid to us. Costs for visas, commercial air tickets, and independent arrangements may not be refundable. If we must change or cancel the trip after departure due to circumstances beyond our control, we will not reimburse you for expenses incurred. We reserve the right to terminate the trip without refund if your behavior is deemed dangerous or damaging.
3. Itinerary Changes
Changes by You: We will attempt to assist with itinerary changes after departure, but changes may not be possible. All change costs are non-refundable.
Changes by Us: We may modify the itinerary due to unforeseen circumstances. We are not responsible for resulting expenses, which will be your responsibility. We reserve the right to alter or withdraw any part of the program for safety or operational reasons.
4. Travel Documents
You are responsible for obtaining required visas, passports, and other travel documents. Passports must be valid for six months after the trip return date and have sufficient blank pages. Failure to obtain proper documentation does not negate these Terms, and no refund will be given if you cannot travel due to missing documents.
5. Health and Wellness Requirements
You are responsible for consulting a physician before travel, obtaining necessary vaccinations, and ensuring you are in adequate health for the trip. Any medical conditions must be disclosed in writing at the time of booking.
6. Assumption of Risk
You acknowledge and assume all risks associated with travel, including injury, illness, theft, delays, cancellations, and events beyond our control. You are responsible for your safety, belongings, and any consequences of your actions during the trip.
7. Travel Insurance
You are responsible for purchasing comprehensive travel insurance, including coverage for cancellation, health, accident, medical evacuation, and personal liability. We strongly recommend insurance that covers third-party negligence, equipment failure, and other unforeseen losses.
8. Arbitration
Any claim arising from the Documents or services provided shall be settled by binding arbitration in the Netherlands under the rules of the Netherlands Arbitration Association. The substantive laws of the Netherlands shall apply.
9. Exclusive Governing Law and Jurisdiction
The Documents are governed by the laws of the Netherlands. If arbitration is waived, any legal proceeding shall be brought exclusively in the courts of the Netherlands. Both parties waive the right to a jury trial.
10. Non-Waiver
Our failure to enforce any provision does not waive our right to enforce it later. Any waiver of a breach does not constitute a waiver of future breaches.
11. Severability
If any provision is held invalid, it shall be modified to the extent necessary to become enforceable, without affecting the remaining provisions.
